Terms & Conditions

This Agreement ("Terms") governs the relationship between Onyx Vacations, LLC ("Onyx Vacations," "we," "us," or "our") and you, the client ("Client," "you," or "your"). By booking a trip, tour, or other travel service with us, you agree to be bound by these Terms. Please read them carefully.

Onyx Vacations, LLC is an independent agency authorized to operate under WorldVia.

I. Core Definitions

Booking - A confirmed reservation for Travel Services made by Onyx Vacations on your behalf.

Supplier - An independent, third-party provider of Travel Services (e.g., airline, hotel, tour operator, cruise line).

Traveler - You, and any other person included on the same Booking.

Travel Services - The travel products and services provided by Suppliers, such as transportation, lodging, tours, and excursions.

Trip - The composite of all Travel Services on your Booking.

Trip Documentation - The documentation and communications we provide to you detailing the specifics and pricing of your Trip.

Authorized Party - Onyx Vacations or any Supplier, including their respective agents and representatives.

II. Client Acceptance and Responsibilities

By initiating a Booking, each Traveler agrees to the following:

A. Acceptance of Terms

Authority to Book: You confirm you are at least 18 years old and have the authority to accept these Terms on behalf of all adults and minors in your household included in this Booking.
Review Documents: You agree to carefully read and understand these Terms, all correspondence, the Travel Client Agreement, and your Trip Documentation.
Report Errors: You must notify us within 24 hours of receiving your Trip Documentation if you find any errors or omissions. Failure to do so may result in fees or cancellation.

B. Financial Obligations

Timely Booking: You agree to contact us well in advance of your travel dates to secure availability, avoid late-booking fees, and prevent fare increases.
Scheduled Payment: You must make all required deposits and final payments strictly by the due dates specified in your Trip Documentation.
Reimbursement: You agree to promptly reimburse Onyx Vacations for any costs incurred due to your violation of a Supplier’s terms.

C. Travel Preparedness

Passports & Visas: You are solely responsible for ensuring all Travelers have a valid passport (valid for at least six months beyond the return date) and all necessary visas, permits, and other travel documents.
Health & Entry Requirements: You are responsible for consulting with a medical professional to meet all health, vaccination, and testing requirements for your destination(s).
Travel Advisories: You must regularly review and stay informed about current travel warnings and advisories from governmental sources related to your Trip.

III. Third-Party Suppliers and Limited Liability

Onyx Vacations acts strictly as a booking agent for independent third-party Suppliers.

A. Independent Suppliers

Independence: Suppliers are independent parties and are not employees, agents, representatives, or affiliates of Onyx Vacations.
Separate Terms: All Travel Services are subject to the Supplier's own terms and conditions, which are separate from this Agreement. You are responsible for understanding and complying with all Supplier rules, restrictions (e.g., baggage, check-in/out times, age limits), and payment terms. Your Trip Documentation identifies each Supplier.
Consent: By paying for Travel Services, you consent to the use of those specific Suppliers.
Supplier Bankruptcy: We have no special knowledge regarding the financial condition of any Supplier. If a Supplier declares bankruptcy, they may not be obligated to provide the Travel Services or refunds. Onyx Vacations is not permitted to provide refunds in this situation.

B. Limitation of Our Liability

Onyx Vacations is not liable for any breach of contract, change in service or route, failure to comply with laws, or any willful or negligent acts or omissions by a Supplier.

We are not responsible for any outcome that may result from a Supplier's action or inaction, including:

Price increases, delays, or inconvenience.
Damage, loss, costs, injury, or death to Travelers.
Denial of access, cancellation of reservations, or forfeiture of amounts paid due to your violation of Supplier terms.

Onyx Vacations is also not responsible for:

The transparency or disclosure of a third party's pricing.
Loss, injury, accident, or expense due to weather, airline operations, or equipment failure.

IV. Pricing, Payment, and Refunds

A. Pricing and Inclusions

Inclusions: Quoted prices are based only on the precise items detailed in your Trip Documentation.
Exclusions: Prices generally DO NOT include:
- Government-imposed fees, taxes, or surcharges (e.g., airport, security, visa, customs fees).
- Personal charges (e.g., meals, gratuities, baggage fees, seat assignments, laundry, transfers, or any medical costs).
Price Changes: All Supplier prices and availability are subject to change without notice until full payment is received. Even after full payment, you agree to pay additional variable fees beyond our control (e.g., fuel surcharges).
Corrections: We reserve the right to correct errors or omissions regarding prices at any time and to re-invoice you at corrected prices.

B. Payment, Cancellation, and Re-Booking

Late Payment: Failure to pay any deposit or amount by its due date may result in:
- Supplier-imposed price increases, fees, or penalties.
- Cancellation of Bookings by the Supplier or Onyx Vacations.
- Forfeiture of previous deposits and amounts paid, which may be NON-REFUNDABLE.
Client Changes/Cancellations: If you change or cancel a Booking, you will be subject to all applicable Supplier fees, charges, or penalties. Supplier terms may not allow refunds for partial use, no-shows, or cancellations for any reason, including health matters or political unrest.
Agency Re-Booking Fee: If you request a re-Booking due to a cancellation, Onyx Vacations may, at its discretion, charge a NON-REFUNDABLE fee for our services.
Agency Cancellation: We reserve the right to modify or cancel any Trip if minimum Supplier occupancy requirements are not met. We are not responsible for non-refundable external bookings (e.g., separate flights, rail) made outside of these Terms.

C. Credit and Debit Cards

Authorization: By submitting your card information, you authorize Onyx Vacations (or our agents) to charge your card for all payments on agreed due dates and to credit your card for any amounts charged in error.
Costs of Recovery: You are responsible for all costs, including recovery costs, if:
- You provide an incorrect card number.
- Valid charges are declined or there are insufficient funds.
- Your card account is closed or expires before all amounts are paid.

D. Chargebacks (Disputed Charges)

You agree not to initiate any credit or debit card chargeback, reverse-charge, or recollection ("Chargeback") for any reason related to your Trip, except in the case of fraud.

Pre-Chargeback Requirement: Even in the case of fraud, you agree to first address the matter directly with us in writing and give us a reasonable time to investigate and respond before initiating a Chargeback.
Chargeback Costs: If you initiate a Chargeback without our prior written authorization, you agree to pay us for all fees and legal expenses we incur to dispute and respond to that Chargeback.

V. Travel Risk and Insurance

Onyx Vacations is not an insurance agent or provider. We advise Travelers of the availability of travel insurance.

A. Recommendation and Acknowledgment

Inherent Risks: You understand that your Trip involves inherent risks, unplanned events, and may incur fees for changes and cancellations, some of which may be NON-REFUNDABLE.
Recommendation: We strongly recommend that you purchase travel insurance to cover each Traveler.

B. Insurance Responsibility

Client’s Choice: You are solely responsible for choosing to buy (or not to buy) travel insurance.
Policy Review: If you purchase insurance, you are responsible for reading and understanding all details and terms of the policy, including any restrictions or exclusions for pre-existing conditions, pandemics/epidemics, or high-risk activities/locations.
Waiver for No Insurance: If you choose not to buy travel insurance, you:
1. Accept all risks related to your travel.
2. May lose up to 100% of the cost of your bookings, plus any applicable fees.
3. Waiver: Waive all claims against Onyx Vacations for damage, loss, cost, injury, or death related to your travel, including but not limited to, changes, cancellations, baggage loss, supplier defaults, and medical costs.

You waive all claims against and indemnify Onyx Vacations for any damage, loss, or cost related to: (1) your decision regarding travel insurance; (2) any policy you buy; and (3) any claim your insurer may deny.

VI. Conduct and Consequence

A. Traveler Conduct

Personal Responsibility: You are responsible for any damage or loss caused by your acts or omissions and agree to make full payment for such damage directly to the Authorized Party or third party.
Indemnification: You agree not to hold Onyx Vacations accountable for any claims arising from your acts or omissions.

B. Removal from Service

An Authorized Party may refuse or require you to leave any Travel Service or disembark any mode of transportation if they reasonably believe your behavior:

Poses a danger to yourself or others.
Is socially disruptive, abusive, harassing, discriminatory, or obnoxious.
Is contrary to applicable law.
Violates any rule or instruction of an Authorized Party.

C. Consequences of Removal

If you are removed from service by an Authorized Party:

You will be left at the location where the mode of transport stops.
You will be solely responsible for all subsequent costs for subsistence, accommodation, and transportation.
You forfeit any right to a refund, in whole or in part, for any fees paid for Travel Services.
The Authorized Party will have no liability relating to your removal.

VII. Governing Law and Dispute Resolution

A. Governing Law

This Agreement shall be governed by the laws of the State of Virginia.

B. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through binding arbitration in Bealeton, Virginia, unless otherwise agreed upon by both parties in writing.
